'Year of hell' after false rape claim

A Mangakino man falsely accused of raping a 14-year-old girl says the stigma is something he'll never be able to shake.

Leonard Joseph, 42, is a shattered man. The pain and distress the ordeal have caused him and his family are evident on his face as he relives his "year of hell".

Mr Joseph was last week acquitted at the High Court in Rotorua on all charges relating to the alleged rape of the 14-year-old Mangakino girl in March, 2009. The charges he faced included abduction, forcibly taking a minor and rape.

The jury took just seven minutes to come back with a not guilty verdict following a five-day trial.

His mother, Shirley Joseph, broke down in tears as she described that day.

"I stood by my son 100 per cent all the way through this," she said from her Tokoroa home.

"We have gone to hell and back. I knew he wasn't guilty."

The married father of seven said the charges "destroyed him" and all the work he'd been trying to do for the Mangakino community.

He used to spend five nights a week helping the town's youth by teaching kapa haka, hip hop and rugby league teams through a programme called Slam.

But that life came to an abrupt end when he was arrested and confined to his mother's house on a 24-hour curfew.

After a run-in with his accuser and her family he was remanded in custody. He spent 17 weeks in Waikeria Prison before being released on electronic bail.

"That is just one charge you don't want to go to jail for," Mr Joseph said.

He goes silent for a moment, before describing how he was verbally threatened numerous times and watched as other men around him were beaten and raped.

"Mentally it destroys a person. It almost killed me. I used to be confident. I'm sure it will come back, but it's going to take time. I'm afraid to even walk out on the street; usually I just hide away."

Mr Joseph claimed the girl falsely accused him of rape after the police caught her on her way to Tauranga in a car she had stolen from her parents.

She told police she had to leave Mangakino because Mr Joseph raped her.


"I went through a year of hell. But what kept me sane was knowing that one day I'd get her up on the stand. I couldn't say anything until we got to court."

Not only did Mr Joseph suffer because of the lie, his family was also tainted. Mr Joseph said women should think of the consequences before making such accusations.

"It's not just one man that you are doing this to ... it affects everyone. I wouldn't want any man to go through what I've been through."

Mr Joseph said he would like to see the girl charged but his barrister Jonathan Temm didn't think it was worth it.

Mr Joseph also had no desire to push for compensation, saying he wanted to put the ordeal behind him.

Mr Temm said the consequences for his client had been "horrific". He said sexual violation cases were not being looked at critically enough before they made it to court.

In Mr Joseph's case the police had written statements from a couple who were asleep in the room at the same time the rape was alleged to have occurred, Mr Temm said.

"So the police knew her version, if not wrong, was at least seriously undermined.

"What happens in these cases is everyone is risk-averse. No-one wants to exercise any discretion as to whether the case will proceed or not."

The officer in charge of the case was not available for comment yesterday.

A woman who claimed she had been raped shortly after Hamilton police launched the serial rapist investigation has been charged with making a false complaint.

The 41-year-old yesterday appeared in Hamilton District Court charged with perverting the course of justice.

Kohine Dallas Pania Turanga claimed a man forced his way into her Albert St, Hamilton East, home about midnight on November 16 last year.

A tearful Turanga was remanded on bail without plea to reappear on July 11.

Turanga's complaint is now one of six reported complaints police have found to be false, with only the rapes being investigated as part of the serial rapist investigation, dubbed Operation Phil, still unsolved. Operation Phil relates to three rapes in Hamilton during April, May and July last year. The five other rape complainants have now all been dealt with by the courts.

The women had a variety of reasons for their fake complaints. Matamata's Chie Ikee, 21, claimed she was dragged into a van and raped by a group of men on Ward Ln on November 14 last year. Police later discovered she was simply trying to seek attention from an ex-boyfriend.

While the circumstances behind the alleged false Albert St complaint are yet to be revealed, Detective Senior Sergeant Chris Page said police had wasted a large amount of police and ESR scientists' resources and time in investigations.

"The media coverage of this (Albert St) incident was significant as police dealt with a number of rape allegations at that time. This case has proven to be the third false complaint from that week.

"It's even more frustrating when real complaints had been put to one side to deal with this and other similar allegations at the time."

Police were still investigating the incident up until last week.

Mr Page said the detrimental impact was far reaching. "Instances such as this are an insult to those real victims who police work closely with."

However, he said the arrest would not hamper Operation Phil.

"Those three complaints that make up Operation Phil remain valid and detectives are committed to locating the offender."

A Hamilton Rape and Sexual Abuse Healing Centre spokeswoman said it was sad women were making false complaints. "It makes women, who have suffered sexual violence, angry and almost brings the whole process into disrepute. It brings doubt ... about the truth."

  RAPE ALLEGATIONS:

FALSE: August 1: Zoe Joy Maxine Arama, 18, Hamilton.

CONVICTED: Ordered to pay $375 reparation.


August 4: 16-year-old Morrinsville girl. Referred to the police Youth Aid section.

November 14: Kohine Dallas Pania Turanga, 41, Hamilton East. Court proceedings underway.

November 14, midnight: 21-year-old Chie Ikee of Matamata.

CONVICTED: One-year suspended sentence.

Between November 12 and 19: Another rape complaint laid, but police discover it's false within 24 hours. She was not prosecuted.

February 29: Caitlyn Ann Moore, 17, of Hamilton.

CONVICTED: Ordered to pay $1800 reparation.

FACTUAL: April, May, July - Three women were raped by a man aged between 18 and 30, with fair hair. File opened and labelled Operation Phil.

UNSOLVED: Police still investigating.

A teenager lied about being raped by two men at a Hamilton park in an attempt to get attention, a court has been told.

Stacey Jane Morgan, a 19-year-old student, was convicted and ordered to pay police more than $3000 reparation in Hamilton District Court this week after earlier admitting making a false statement to police, The Waikato Times reported.

Morgan told police two men raped her at Hamilton's Ward Park in the early hours of October 12 last year.

She was medically examined and later gave a detailed account of the alleged attack.

Police appealed for public help to catch the two men.

But Morgan contacted police two weeks later saying she wanted the investigation stopped.

In a subsequent interview, Morgan admitted the claim was false.

She said she devised the story to get attention from her father and an ex-boyfriend

Accusing someone of rape when it isn't true it a particularly  nasty thing to do.     They should be made to appear on television during peak time viewing  to make a statement acknowledging the lie and apologise.  To be rerun several times a day for a fortnight so everyone knows what  a skanky scumbag troll they are.

Unfortunately the manhaters that run groups such as the "Womans Web Rape Crisis" etc, have obtained the ear of Justice and Police.
Police are now so frightened of mistakenly saying that a rape complaint is bullshit, even though it seems so extremely doubtful, that they are now strongly biased to the side of the complainant.

Christchurch teen admits false rape complaint

A Christchurch teenager has admitted she made a false complaint of being forced into a car on Riccarton Road, tied up, and repeatedly raped.
She was told by Judge Stephen Erber in the Christchurch District Court today that her lies had "devalued the currency" for women who made genuine complaints of rape.

People might consider other women's complaints more sceptically because of the actions of 19-year-old student Michelle Anne Taruka Grafton, he said.

Grafton eventually admitted the complaint was false and pleaded guilty in court today to a charge of making a false statement that a crime had been committed.

"In explanation, she stated she did it because she liked the attention," police prosecutor Constable Michael Tualii told the court.

He said the police were called because of what Grafton told medical staff.

She told police she had been abducted by a man she knew at 3pm on Saturday December 19, from Riccarton Road.

She said he had forced her into a car, driven her to an address in Yaldhurst, and tied her hands to a sofa bed where she was forced to have sex with him several times.

She managed to escape at 7am next day, when he left for work.

A specialised medical examination for victims of sexual assaults was carried out.

Grafton was interviewed again at the Christchurch South Police Station four days later and signed a written statement repeating her claims.

"Subsequent police inquiries have revealed these allegations to be totally fabricated," said Mr Tualii. Grafton admitted lying, when she was interviewed again on February 28.

Judge Erber remanded her on bail for sentence on July 1.

She should be named irrespective of her age.   If she is old enough to contrive this story she is old enough to take the consequences.

There are some mothers out there that play the kiddy fiddling card to revenge on an ex or on a former friend.

Since those accused are often too well off (if only just) to get legal aide they and their families go though hell even when it never gets near court.

I feel sorry for the men accused of this ( in some cases)  because even though the girl is a proven liar there will be some who will still question his involvement with her.

Woman arrested after alleged false rape complaint

A 22-year-old woman who claimed she was raped in Wanganui last month has been charged with making a false statement.

The 22-year-old woman said she was attacked in the Portal Street area of Durie Hill on January 16. Police investigated, and she was arrested last Friday, the Wanganui Chronicle reported.

She was given name suppression when she appeared in Wanganui District Court yesterday.

A 15-year-old girl has admitted she made up a story about being raped while walking home from school on February 27.

"This admission has left police disappointed and frustrated at the actions of the girl," Detective Sergeant Robbie Hermann of Waikato Criminal Investigation Branch said.

"Many hours work that could have been spent on investigating genuine cases of child abuse have effectively been lost," he said.

As a result of the complaint people had become worried about their safety.

"I regard Hamilton to be a safe city where children can walk to and from school without fear of attack by a sexual predator.

"While establishing this complaint had no validity parents and caregivers should always remain vigilant about their children's movements including going to and from school," Det Sgt Hermann said.

The girl will be referred to youth aid. "At the end of the day this is still a young person in need of assistance and we would like to thank all those members of the public who gave of their time during the course of our investigation," Det Sgt Hermann said.

By the way they are talking there's some mental issues going on with her.  On the one hand I have some compassion for her being in a state.  On the other I want to slap her silly for being such a stupid bint.
