Bain 111 Claim : I Shot the Prick

NZ Herald

The Supreme Court has lifted a suppression on part of the 111 emergency call David Bain made after five members of his family were killed.

The suppressed words are alleged to be: "I shot the prick".

Chief Justice Sian Elias said it was important to note that the words were unclear, which is why they were not allowed in the court case itself.

Mr Bain was last week acquitted of the murder of his parents and three siblings in Dunedin in 1994.

It was so unclear, it may not have even been words as such but some people will hear only what they want to hear like seeing pictures in clouds or the face of the madonna in a tree trunk.

It would be fair to say that if the inadmissable evidence [some of it once posted on here even] had been heard by the jury, the outcome may well have been very different. 
Being aware of of this evidence, you may well know an accused is guilty, but a jury unaware of it will find him NG.  The verdict doesnt stop him from being guilty of the crime, however.

The Supreme Court suppression has been lifted on both the alibi-plan and the 111 tape.


David Bain trial: Alibi-plan evidence kept secret from jury
David Bain told a school friend that he could rape a woman and use his paper round as a false alibi, according to secret evidence that was suppressed during his murder trial.

The court suppression has now been lifted.

The jury in the 12-week trial never heard the witness statements of the former Bayfield High School students, as the Court of Appeal ruled that the Crown evidence was too prejudicial against Mr Bain.

Now that Mr Bain has been found not guilty of murder, the Herald can reveal the evidence of Mark Buckley and Gareth Taylor, who say Mr Bain planned a rape of a female jogger while at high school.

In its judgment, the Court of Appeal said that while the words "rape" and "alibi" were not attributed to David Bain by the witnesses, both those words were used by the court for ease of reference because they seemed to capture the essence of what was proposed (at least on the challenged evidence).

The pair told police Mr Bain had a sexual interest in the young woman and told Mr Buckley in 1990 that he could use his paper round to "get away" with the proposed crime.

Anyway obviously tape was not  witmesses may have been saying what they wished or thought he said.

All the naysayers will be out in force denigrating this information.

I know the jury faced an impossible task, the defence had 14 years to polish their mirrors and generate the smoke.
I hope they have a few sleepless nights - but it doesnt matter in the long run, the guy has already done time for what was done for as long as is usual in these circumstances, if he had been reconvicted he wouldnt have done any more.
The point that sticks in my craw is that by implication, a gentle old man has been put in the frame as a heartless killer

And Tamihere would know his arse from his elbow?     If you are reduced to believing anything Tamihere would utter I can understand why you are interested in this thread.
It is all quite simple really.   If this was infact words that were uttered...and of course they were not... The tape would have been used as evidence and DB arrested having confessed.         Experts.....EXPERTS... have said the sounds on the tape are not words.       I shan't bother reading any further additions to the thread because it is old.  Done to death.
