Trump may face a reckoning in case brought by female accuser

If a defamation case proceeds to trial, it could put the president face-to-face with his past.

IN THE WEEKS leading up to his election, Donald Trump went on a tear against a list of women who had accused him of touching them inappropriately. One was Summer Zervos, who had been a contestant on his reality television show.

“False stories. All made up. Lies. Lies. No witnesses. No nothing. All big lies,” Trump declared at a rally after the Californian made a statement alleging that Trump kissed and groped her in a 2007 encounter at the Beverly Hills Hotel.

“Total fabrication,” he told a cheering crowd in Gettysburg, Pennsylvania. “The events never happened. Never. All of these liars will be sued after the election is over.”

As the nation wrestles with a historic shift in how to address old charges of sexual misbehavior, allegations against Trump, which date to his days as a New York developer, have become part of the public debate. Trump has repeatedly said the accusations against him are groundless. But by turning personal and branding the women liars, Trump has perhaps unwittingly played into a cutting-edge strategy in the legal pursuit of sexual misconduct — claims of defamation such as those used against comedian Bill Cosby and in a lesser-known New York case, argued by two lawyers who are now representing Zervos.

The defamation suit filed in January in New York State Supreme Court by Zervos, a short-lived contestant on “The Apprentice”, has reached a critical point, with oral arguments over Trump's motion to dismiss scheduled for Tuesday, after which the judge is expected to rule on whether the case may move forward.

If it proceeds, Zervos's attorneys could gather and make public incidents from Trump's past and Trump could be called to testify, with the unwelcome specter of a former president looming over him: It was Bill Clinton's misleading sworn testimony — not the repeated allegations of sexual harassment against him — that eventually led to his impeachment.

“It's almost a train you can't stop going down the tracks,” said Joseph Cammarata, who represented Paula Jones against Clinton and, more recently, represented seven Cosby accusers in a defamation suit. “It opens him up to have to answer questions about sexual relations, other relationships, what might have been said, to open up your whole life.”

The use of defamation to litigate an underlying allegation of sexual misconduct addresses other challenges: Often, the statute of limitations is up before accusations come to light; in some instances, the he-said-she-said nature of the testimony makes accusations hard to prove.

“An allegation of defamation against somebody who can seem flamboyantly reckless with the truth may have a higher probability of sticking,” said Naomi Mezey, a law professor at Georgetown University. “Some women feel equally injured and sometimes more outraged by being publicly attacked and called liars for doing what they feel was very brave and in some respects a public service.”

Zervos came forward after The Washington Post's publication in October 2016 of an “Access Hollywood” video with audio of Trump bragging about grabbing women's genitals. She issued a statement on October 14th alleging that Trump kissed her when she visited him at Trump Tower in December 2007 and that he kissed her, groped her breast and “began thrusting his genitals” when he invited her to join him for dinner later that month in a bungalow at the Beverly Hills Hotel.

The allegations surprised people in Zervos's home town of Huntington Beach, California, where she attracted attention when she was chosen in a national search for Season 5 of “The Apprentice”. But Trump fired her abruptly at the end of the first episode. After filming finished, Zervos returned to work at Sunny's, her family's diner. Several of her acquaintances recalled in recent interviews their shock at seeing Zervos appear on television to make allegations about Trump.

“We couldn't believe it,” said Kathy May, a Trump supporter who recalled conversations at the time.

Zervos is represented by Gloria Allred and her New York based co-counsel, Mariann Meier Wang, who declined to make Zervos available for questions. Allred says she represents Zervos pro bono on her website, where she appeals for donations to pay Zervos's other legal expenses and says excess contributions will go to rape crisis centers.

Allred and Wang have demonstrated their determination to prove the allegations. They subpoenaed the Trump campaign in March for documents concerning Zervos and “any woman who asserted that Donald J. Trump touched her inappropriately.” The lawyers agreed to suspend the document release until after the New York judge rules.

Allred declined in an interview to discuss her evidence-gathering strategy but said, “We're not going to be limited to that which we have itemized in our subpoena.” In news conferences, she has been asked whether targets could include out-takes from “The Apprentice”, which might show how Trump treated female contestants such as Zervos.

If the suit goes to trial, Allred, who appeared at news conferences last year alongside three other Trump accusers, could bring other women to the stand.

“My read of the case is that it is designed to force the president to make public material that he would prefer to keep private,” said David Marcus, a law professor at the University of Arizona.

By filing in New York, Allred and Wang have chosen a state where Zervos's claims may be met with sympathy, said Robert Rabin, a Stanford University law professor. A New York jury is likely to be “anti-Trump, anti-sexual-misconduct and [have] generally liberal norms,” he said.

Allred and Wang settled a defamation case there in 2015. In that suit, two clients accused Syracuse University basketball coach of defaming them after they spoke up about sexual abuse that they said occurred when they were ball boys for the team.

“We think that that is an important precedent on what the issue of defamation is in New York,” Allred said in a recent interview.

Marc Kasowitz, Trump's personal attorney, said in a statement that Zervos's case has “no merit,” describing it as “politically motivated” and “based on allegations of events that never occurred.” Paul Burgo, a lawyer in Kasowitz's firm, wrote in a recent email that they had no further comment and are seeking “dismissal and alternatively a stay on Constitutional grounds”.

White House press secretary Sarah Huckabee Sanders said the administration also had nothing to add about the case. Responding to a reporter's question at a news briefing in late October, Sanders affirmed that the official White House position is that the women are lying.

That has been Trump's stance from the beginning. After Zervos made her allegations, Trump posted a statement on his campaign website: “To be clear, I never met her at a hotel or greeted her inappropriately a decade ago.” He decried what he called “made up events”, “100% fabricated and made-up charges”, saying in the last presidential debate that the women were put forward by the campaign of Hillary Clinton, his Democratic rival, or motivated by the desire for “ten minutes of fame”, according to Zervos's complaint.

In a November statement, Zervos described repercussions after Trump accused her of untruthfulness. “After he called me a liar I was threatened, bullied and saw my business targeted,” she said, asking for a retraction of his statements about her and other women.

Two months later, she filed suit.

Her attorneys' strategy has challenges, which have prompted an almost year-long battle with Trump's lawyers. Legal scholars are debating everything from broad constitutional questions of presidential immunity to the finer points of New York law and whether Zervos could appeal should the judge defer the suit until Trump leaves office.

“Of all the many logic puzzles this case presents, the possibility of a deferral ventures into uncharted waters and would likely send the attorneys to the mat,” said J. Maria Glover, a Georgetown University associate law professor who specializes in complex litigation.

Trump's attorneys argue that the president is immune and that the comments he made were political opinion and therefore “squarely protected by the First Amendment.”

In 1997, a Supreme Court ruling made it possible for a sitting president to be sued for private actions that occurred before he took office. Trump's attorneys are arguing that Clinton versus Jones, which applies to federal litigation, does not apply in state courts.

“That is where [Trump's attorneys] are putting their linchpin,” said John L. Diamond, a law professor at the University of California Hastings College of the Law in San Francisco.

Trump's unusual status, as a candidate and then a sitting president, is not the only complicating factor. Zervos may also face special scrutiny as a former contestant on Trump's show.

The burden of proof lies with the plaintiff. To show Trump defamed her, she must first demonstrate that her allegations against him were accurate.

If she is deemed a private citizen, Zervos simply would have to show that Trump was negligent toward the truth. If she is a public figure, the bar is far higher.

“She would have to prove he knew [what he said] was false or had reckless disregard for the truth,” said Lee Levine, senior counsel at the law firm Ballard Spahr.

Some experts suggest that the suit could surface one of the mysteries of the 2016 campaign — unused footage from “The Apprentice”.

Trump starred on the show for more than a decade, and multiple cameras captured scenes that never appeared on television. The boardroom drama, which lasted a few minutes on the show, could take 1½ hours to shoot, with Trump playing contestants against one another.

Speculation about the out-takes soared after the “Access Hollywood” video was reported. Bill Pruitt, who worked on “The Apprentice”, tweeted, “As a producer on seasons 1 & 2 of #theApprentice I assure you: when it comes to the #trumptapes there are far worse.”

But Scott Salyers, the show's supervising casting producer, said in an interview, “I think those out-takes would no longer even put a blip on the radar.”

Salyers spent time with Trump during contestant selections. “He is who he is,” Salyers said — outspoken, prone to off-the-cuff outbursts, an ideal reality-TV star.

Those same traits could become liabilities for Trump, should he take the stand.

“I am not suggesting [Trump] will lie under oath,” Allred said in an interview. But, she added, if the president were to lie, perjury is considered a high crime and misdemeanor and could prompt impeachment hearings.

The stakes for the president go beyond sexual misconduct or defamation: If the judge decides the case cannot proceed, the ruling could stymie attempts to bring other civil suits against Trump in state courts. If, on the other hand, the suit does proceed, it could encourage more litigation against a president who entered office with an unusual array of lawsuits in his wake.

And if Zervos wins, her victory could embolden other accusers.

“There are 10 or 11 other women waiting in the wings,” Rabin said.

Stormy Daniels Out of His Own Pocket

MICHAEL D. COHEN, President Trump's longtime personal lawyer, said on Tuesday that he had paid $130,000 out of his own pocket to a pornographic-film actress who had once claimed to have had an affair with Mr. Trump.

In the most detailed explanation of the 2016 payment made to the actress, Stephanie Clifford, Mr. Cohen, who worked as a counsel to the Trump Organization for more than a decade, said he was not reimbursed for the payment.

“Neither the Trump Organization nor the Trump campaign was a party to the transaction with Ms. Clifford, and neither reimbursed me for the payment, either directly or indirectly,” Mr. Cohen said in a statement to The New York Times. “The payment to Ms. Clifford was lawful, and was not a campaign contribution or a campaign expenditure by anyone.”

He declined to answer several follow-up questions, including whether Mr. Trump had been aware that Mr. Cohen made the payment, why he made the payment or whether he had made similar payments to other people over the years.

Mr. Cohen has previously said that Mr. Trump has denied an affair with Ms. Clifford, whose stage name is Stormy Daniels. She has said the affair took place soon after Mr. Trump's wife, Melania, gave birth to the couple's son, Barron.

Mr. Cohen's statement about what he called “a private transaction” was the first time that he had acknowledged a role in the payment, which was first reported in January by The Wall Street Journal.

Mr. Cohen said that he had given a similar statement to the Federal Election Commission in response to a complaint filed by the government watchdog group Common Cause, which contended that the payment, made through a limited liability company that Mr. Cohen established, was an in-kind contribution to the Trump campaign.

Officials with Common Cause also sought to determine whether the payment was made by the Trump Organization or another person.

“The complaint alleges that I somehow violated campaign finance laws by facilitating an excess, in-kind contribution,” Mr. Cohen said in his statement. “The allegations in the complaint are factually unsupported and without legal merit, and my counsel has submitted a response to the F.E.C.”

He said he would not make any additional comments about the commission complaint “or regarding Ms. Clifford.”

Mr. Cohen was among Mr. Trump's fiercest defenders during his time at the Trump Organization, often telling reporters during the 2016 presidential campaign that even false information about Mr. Trump could be damaging if printed. Ms. Clifford had told her story to the magazine In Touch in 2011, as well as the gossip website TheDirty.com. Both accounts were published last month after the report of the 2016 payment.

In fall 2016, Ms. Clifford was once again in discussions with news outlets, this time more mainstream. The payment from Mr. Cohen reportedly came a few weeks before Election Day — around the same time as the release of the Access Hollywood” tape that showed Mr. Trump boasting about grabbing women's genitals without their consent.

Ms. Clifford has not publicly denied an affair with Mr. Trump. A statement released by Mr. Cohen in her name in January denied an affair, but in interviews, she has refused to directly answer questions about it.

She is one of at least two women who claimed to have had affairs with Mr. Trump but who were kept silent through legal agreements. The other is Karen McDougal, a former Playboy model. Ms. McDougal sold her story to the company that owns The National Enquirer, but it was not printed, The Wall Street Journal reported in 2016.

Hope Hicks, now the White House communications director, said at the time that the report of an affair was “totally untrue” and that the Trump campaign had “no knowledge” of any payment to Ms. McDougal.

MOST POLITICIANS would have been swallowed up in scandal after new details emerged Friday of an alleged affair — with a Playboy Playmate, no less — that occurred the same weekend of a reported dalliance with a porn star.

Not Donald Trump.

In eight pages of handwritten notes published by the New Yorker, 1998 Playmate of the Year Karen McDougal recalled having sex with Trump in 2006, a few months after his wife, Melania, gave birth to their son, Barron.

McDougal said one of their sexual encounters took place at the same Lake Tahoe golf tournament where porn actress Stephanie Clifford, known as Stormy Daniels, says that she, too, had a tryst with Trump.

The president denies both affairs, but both women received money to keep the matters quiet.

Americans have known for years about Trump's history of adultery, most famously his 1989 cheating on his first wife, Ivana, with his soon-to-be second wife, Marla Maples.

He won the presidency despite accusations of sexual harassment or assault by more than a dozen women, along with an “Access Hollywood” audiotape of Trump boasting that his star power allowed him to grab women by their genitals.

“If you assume someone is a devoutly religious, family-values person, something like this will absolutely destroy their reputation and level their career,” said Lara M. Brown, who runs the Graduate School of Political Management at George Washington University.

“If, on the other hand, you believe this is who they are going in, which, if you heard the ‘Access Hollywood’ tape or listened to interviews with Howard Stern, then this is more confirmation of your belief and your expectations.”

Also, Trump's checkered New York business career — bankruptcies and alleged real estate swindles, among other things — inoculates him from some of the harm that a more conventional politician might suffer as details emerge on the hush money received by McDougal ($150,000) and Clifford ($130,000).

“His business reputation is not necessarily one of high character,” said Brown, an expert on political scandals.

Still, Trump is weathering a rough patch in his presidency, and the McDougal distraction is no help.

The White House's apparent overlooking of domestic abuse allegations against former senior Trump aide Rob Porter could worsen Republicans' troubled standing among women at a time when the #MeToo movement threatens to fuel GOP setbacks in November's midterm election.

McDougal, who confirmed the authenticity of her notes in an interview with New Yorker writer Ronan Farrow, said she was speaking out in part because of the #MeToo movement.

“Every girl who speaks is paving the way for another,” she told the magazine.

Trump and McDougal met at a pool party at the Playboy Mansion, where Trump was taping an episode of his television show, “The Apprentice”, McDougal wrote in the notes.

The New Yorker article, citing previously undisclosed texts, emails and legal records, elaborates on a Wall Street Journal report in 2016 about a deal requiring her to keep quiet about the alleged affair.

It included the $150,000 payment to McDougal from American Media Incorporated, publisher of the National Enquirer, which never printed her story about Trump. David Pecker, chairman and CEO of AMI, is a close friend of the president.

In the supermarket tabloid world, suppressing a story as a favor to a friend or gossip source is known as “catch and kill”.

The National Enquirer published harshly critical articles on Hillary Clinton during the presidential campaign, but AMI denies paying anyone to protect Trump from damaging stories.

McDougal's comments appeared to buttress the accounts of two other women who said Trump pursued them for sex in the early years of his marriage to Melania Trump. Both cases have sparked legal action against the president.

Trump lawyer Michael Cohen told The New York Times this week that he used “personal funds to facilitate a payment of $130,000” to Clifford just before the November 2016 election. In return, Clifford reportedly agreed to keep quiet about the alleged affair.

The non-partisan watchdog group Common Cause has filed a Federal Election Commission complaint saying the payment was an illegal campaign contribution, which Cohen denies.

Like Clifford, McDougal says she had sex with Trump at the American Century Celebrity Golf Championship in Lake Tahoe in July 2006.

The other woman, Summer Zervos, a former contestant on “The Apprentice”, has accused Trump of trying to force himself on her in 2006. She filed a defamation suit against him after he called her a liar.

All three women say their interactions with Trump included encounters in a bungalow at the Beverly Hills Hotel. All three also say they were escorted to the bungalow by Keith Schiller, a long-time Trump bodyguard who left his job in September as the director of Oval Office operations and deputy assistant to the president.

Kathleen Hall Jamieson, a University of Pennsylvania expert on politics and media, said the McDougal and Daniels cases were likely to have minimal political impact on Trump, whose most loyal supporters have ignored all manner of controversial statements and behavior by the president.

“Both instances in the news right now are consensual,” she said. “So it's easy for voters to say, ‘That's Melania's concern, not the voters' concern’ unless there are legal implications, which could be violating the campaign finance laws.”

Scott Basinger, another expert on political scandal, suggested Trump is also shielded by the us-versus-them tribalism of the country's politics and the support of Christian conservatives who might have been expected to respond with outrage, or at least disappointment, at his sordid conduct.

“They've said pretty explicitly that they're going to give him a mulligan on his personal life and anything that happened before he became president is not of interest to them,” said Basinger, who teaches at the University of Houston.

“As long as people believe he can deliver judges like Neil Gorsuch” — Trump's nominee to the U.S. Supreme Court — “they're willing to overlook everything else.”

Whether the first lady is willing to overlook reports about her husband's sex life is another matter.

She canceled her recently scheduled trip with the president to Davos, Switzerland, declined to ride in his limo from the White House to the Capitol for the State of the Union and has been seen swatting his hand away from hers — fueling chatter on the state of their marriage.

AMERICA asks a lot of its first couples. Fairly or not, they become national marital role models. We don't really care if they have separate bedrooms, but we do expect them to demonstrate a certain amount of mutual respect and fondness for each other.

We like it when they seem to be in love, like George and Laura Bush, or Barack and Michelle Obama. Even Bill and Hillary Clinton, for all their woes, seem to take pleasure in each other's intellects and achievements. We also want them to be devoted parents.

We get no good vibes from the Trump marriage.

Trump, who demands adoration, would no doubt love for Melania to gaze upon him the way Nancy Reagan gazed upon her Ronnie. But Ronnie didn't cheat on Nancy with porn stars and Playmates.

What's distressing to many Americans is that Melania seems like a prop in her husband's reality show. During his inauguration last year, when the new president turned around to say something to his wife, her face lit up for a second. As soon as he turned away, her happy mask fell away. Months later, she slapped away his hand as they walked on the tarmac in Israel.

“These people are under constant scrutiny,” said University of Washington sociologist Pepper Schwartz, a sex and relationships expert. “Has anyone ever seen a loving gesture between them?”

Our first lady does not seem to be having a good time. In the last month alone, amid the daily chaos that is the Trump White House, stories about the president's womanizing, and his techniques for suppressing stories about his womanizing, have become fodder for the daily news report.

Porn star Stormy Daniels said she was paid to stay quiet about an affair she alleges she had with Trump shortly after Melania gave birth to their son, Barron. Michael Cohen, Trump's personal attorney and self-described “fix-it guy” for the president, announced he had paid the actress, whose real name is Stephanie Clifford, $130,000, but has not said why.

Last week, the New Yorker reported that former Playboy Playmate Karen McDougal kept a diary of the nine-month affair she began with Trump in 2006, around the same time he was seeing Clifford. McDougal has said that the National Enquirer, whose publisher is a friend and protector of Trump, paid her $150,000 for the exclusive rights to her story, then never ran it. (Trump has denied both affairs.)

Melania had already skipped the billionaire confab in Davos after the Stormy Daniels payment story broke. Then came Playmate McDougal , and more wifely passive-aggression followed: On Friday, Melania's office, citing a scheduling issue, announced she would drive alone to Andrews Air Force Base rather than helicopter there with her husband from the White House.

Maybe Melania passed on the 'copter ride because she is getting tired of walking across the White House lawn in her stilettos, but she was also a no-show at a Mar-a-Lago dinner her husband hosted with Geraldo Rivera and her stepsons, according to The Washington Post.

Melania seems to be punishing Donald, but for what?

“I don't think she ever imagined that he was going to be faithful to her,” Schwartz said. “This is a man who has never stopped pushing himself on women. The preponderance of the evidence, as they say, is pretty convincing.”

The punishment, in that case, must be for the relentless humiliation.


SURELY, Melania Trump knew what she was getting into when she married the man who would become our 45th president.

Twenty-four years her senior, Donald Trump had already been divorced twice. He was a famous adulterer, womanizer and sexist, and a regular on shock jock Howard Stern's radio show, making proclamations about then-girlfriend Melania's breasts, the hotness of his own daughter, his belief that when a woman turns 35, it's “checkout time.”

She rallied to his defense after the infamous “Access Hollywood” tape became public during the 2016 presidential campaign. America's future first lady dismissed her husband's boast about being able to grab women's genitals as just “boy talk,” that her husband had been “egged on” by host Billy Bush.

And then, when more than a dozen women came forward to allege that Trump had sexually harassed or assaulted them over a period of four decades, the former model attacked the women. Their stories, she said, were “lies.”

“This was all organized from the opposition,” Melania Trump, 47, told CNN. “Did they ever check the background of these women? They don't have any facts.”

Well, you certainly can't blame a wife for supporting her husband.

Unless, of course, she's a Democrat, like Hillary Clinton. In which case the wife will be vilified for supporting her husband.

IN THE past year, there has been a lot of speculation about the durability of the Trumps' marriage, mostly focusing on Melania's tolerance levels. Tongue-in-cheek memes include “#FreeMelania”.

Thirteen months ago, at the first Women's March, there were numerous handmade posters, riffing on the first lady's generally stone-faced expression, with variations of “Melania, blink twice if you need help!” And that was long before new details about the porn star and the Playmate emerged.

A Marist Poll released on Valentine's Day (!), found that 43% of Americans think the Trumps should stay together, 34% said Melania should leave and 23% were unsure. I can't imagine what it feels like to have your marriage put to a popular vote.

Over the course of the last year, Melania's approval rating has inched up. She is now far more popular than her husband. This is not much of a surprise; most first ladies are more popular than their mates. In Melania's case, the bar was pretty low given Trump's low ratings, but good for her.

Last fall, during a White House dinner, President Trump acknowledged his wife's popularity, calling her “the star of the Trump family,” according to news reports. “They love her out there, I'll tell you. We walked all over Florida. We walked all over Texas, and they're loving Melania.”

Since he has a history of walking all over his marriage, it's good to know that someone is loving Melania.

Round one will be the lawsuit in the New York State court system from the woman molested by Trump who is suing him for defamation for calling her a liar.

Remember when Trump said he was going to sue all of those women after the election? Well that election was considerably more than a year ago and he still hasn't done what he said he was going to do. I wonder why? Perhaps it was all BLUFF (ie....piss & wind) because Trump KNOWS he sexually molested all of those woman and he is scared about what might come out in court after various lawyers get granted “discovery” by the court to dig through his affairs.

However, Trump cannot stop the lawsuit against him and as it is in a State court and not a Federal court, he has no powers of parden. Hahaha!!!
