Tycoon boasted of his MP mates

A Chinese millionaire on trial in the High Court at Auckland for fraud boasted to immigration officials that he had MP friends who would ensure he got citizenship.

The high-ranking officials were stunned when then Cabinet minister Shane Jones approved the application one day after getting his file. They were certain Yong Ming Yan, also known as Bill Liu, who had been red-flagged by Interpol, stood little chance.

But Yan leaned back in his chair, with his arms behind his head, and said he was 99 per cent confident he would get citizenship, the court was told yesterday.

"He said he had a lot of support from members of Parliament ... he was going to take them to China," Internal Affairs case officer Olele Johannes Gambo said.

If proven, the allegation of special treatment would be serious enough to warrant investigation by the police.

Yan was granted citizenship by Mr Jones in 2008, after officials repeatedly told him that Yan failed a required good character test, the court was told.

Mr Gambo said that when Yan was told he could not have citizenship, he said friends in Parliament would ensure he got it.

Mr Jones, who refused to comment on the allegations last night, was named in court with former Labour MP Dover Samuels.

The court was told Yan was sworn in as a citizen within a day of Mr Jones approving citizenship.

Yan had gained permanent residency and applied for citizenship in April 2008.

There was "a lot of pressure for us to complete the file", Mr Gambo told the court.

It was clear Yan would fail the good character test. He was wanted on Interpol Red Notices based on arrest warrants issued in China.

The file went to Mr Jones on May 23, 2008. Yan was sworn in as a New Zealander the next day. "It is very unusual," Mr Gambo said.

Internal Affairs investigating officer Bruce Ross told the court Yan was happy to let his application go to the minister.

The department then prepared a recommendation for the minister to decline the application on good character grounds.

Officials met twice with Mr Jones in Wellington.

Yan's age and true identity are unknown. Court files refer to him as William Yan, Bill Liu and Yang Liu, list several birth dates and say he arrived from China in 2001.

He is appearing before Justice Timothy Brewer on five charges that he fraudulently used documents to falsely claim New Zealand citizenship.

Mr Jones last night refused to comment "while it's in front of the court". He had "most certainly not" gone to China. Mr Samuels did not respond to a request for comment.

MPs' rich friend arrested at airport

Police have charged a multi-millionaire businessman, who was granted New Zealand citizenship in controversial circumstances, with making false declarations on immigration papers and using fake identities to obtain a passport.
 
Yong Ming Yan - also known as Bill Liu, Yang Liu and William Yan - was supported in his citizenship bid last year by Labour MPs Dover Samuels and Chris Carter, and National MP Pansy Wong.
 
Police arrested him last Saturday as he was about to board a plane to leave the country.
 
He appeared in Manukau District Court, and is facing 12 charges in relation to false declarations on his immigration papers, having false passports and using deception to gain citizenship.
 
Yan entered no plea to eight charges under the Crimes Act, two under the Passport Act and one under each under the Immigration Act and Citizenship Act.
 
Police opposed bail, but Judge Gus Andree Wiltens approved it, setting strict residency, curfew and reporting conditions.



 The bail conditions were altered when Yan appeared before Judge Oke Blaikie in the Auckland District Court yesterday. He is required to report to Auckland central police station twice daily.
 
Weekend Herald inquiries found that two Auckland properties owned by Yan, an apartment in the Metropolis tower and a waterfront home on the North Shore, were sold on January 12 for $10.5 million.
 
The criminal charges are embarrassing for several MPs who assisted Yan's successful bid for citizenship, granted last August.
 
Yan became a New Zealand citizen under the name Yang Liu, but changed his name days later and was granted a passport in the name of William Yan.
 
Passports he held in two other names were earlier seized by investigators.

He was granted citizenship in a VIP ceremony in Wellington last year after lobbying from former Labour MP Dover Samuels, who regards him as a close friend.
 
Rick Barker, the then Internal Affairs Minister charged with approving citizenship applications, was also on the list of politicians who knew Yan. Because of this, he passed the file to another minister, Shane Jones.
 
Mr Jones overruled Internal Affairs advice that Liu - now Yan - did not meet character requirements and granted him citizenship.
 
Mr Jones, now the Opposition spokesman for economic development and the environment, last night declined to comment.
 
Among the reasons officials gave for opposing Liu's citizenship application was that they did not know his true identity as he had two names, two passports and two birthdates.
 
The citizenship was granted nine months after officials advised the Immigration Minister at the time, David Cunliffe, that dual identities allegedly used by Liu were grounds to revoke his permanent residency.
 
In 2006, Australian authorities sent to the Chinese Government A$3.37 million seized from bank accounts that Liu controlled.
 
The money was frozen because authorities suspected him of opening and operating bank accounts using a false name. He agreed to forfeit the money without admitting liability.
 
He was also known as Bill Liu in New Zealand, where he has been a resident since 2002.
 
Chinese authorities allege that his real name is Yong Ming Yan and that he stole the identity of a Yang Liu by falsely registering his birth in 1999.
 
Yan is well known in Chinese business circles and owns the Jade Terrace restaurant in Manukau.
 
The restaurant hosted election fundraising dinners last year for Labour candidate Raymond Huo, National's Ms Wong and Act's Kenneth Wang.
 
Yan also made donations of $5000 each to Labour and National in 2005.

Pressure on Jones over citizenship case

Labour MP Shane Jones' political future is under a cloud after claims he improperly intervened in a Chinese millionaire's citizenship application.
 
Mr Jones is facing pressure over his approval of Yong Ming Yan's citizenship application four years ago. Yan, also known as Bill Liu, is on trial for fraud related to his citizenship application.
 
Last week Internal Affairs case officer Olele Johannes Gambo told the High Court at Auckland that Yan boasted to immigration officials that his political connections would ensure his citizenship application was approved. That was in spite of the fact he had been "red flagged" by Interpol.
 
Yan's application was subsequently granted by then-associate Immigration Minister Mr Jones in 2008 in the face of warnings from officials that Yan had failed the good character test.
 
Labour leader David Shearer last night said he had spoken to him over the weekend "and tomorrow I'll be able to give you the full conclusions from those discussions".
 
Mr Jones was demoted from Labour's front bench two years ago after it emerged he had viewed and paid for pornographic films using his ministerial credit card.
 
It was too early to comment on whether Mr Jones, "a very valuable member of the team" was likely to face a further demotion or even more severe measures, said Mr Shearer.
 
Mr Shearer has been calling on Act leader John Banks to be relieved of his ministerial portfolios while police investigate whether he breached the Local Government Electoral Act by declaring donations to his 2010 Auckland mayoral campaign from German billionaire Kim Dotcom as anonymous.
 
But he said last night the questions around Mr Jones' involvement in the Yan case were not as serious as those around Mr Banks donations from Dotcom.
 
The strength of the evidence against Mr Jones was "very arguable".
 
Mr Jones has declined to comment on the matter.

Jones admits issues over millionaire's passport

Labour MP Shane Jones has admitted there were questions over the identity of the Chinese millionaire he controversially gave a New Zealand passport to.

Jones approved the application from Yong Min Yan, who is standing trial for passport fraud.

He overruled the advice of internal affairs officials who said Yan's citizenship should not be approved.  Yan - also known as Bill Liu - had been red-flagged by Interpol, had a number of identities and his Australian bank accounts were frozen.

Jones said today: ''Look, I certainly know that there was a live issue as to whether or not this man is who he says he was. Without access to files I just really can't tell you whether I can recall...''

Earlier in 2008, immigration officials had recommended Yan's residency - granted in 2002 - be revoked. Then-immigration minister David Cunliffe told them to investigate further.

Jones said he wasn't briefed by Cunliffe or immigration officials.

''I don't remember ever talking to David Cunliffe about this guy ... I don't ever recall being briefed by the immigration department on this issue. And the man was a resident as far as I was concerned, as I recall.''

He added: ''Um, in fairness it's four years on. Without having access to the file I just can't fully recollect. But what I do know is that there was always a mystery as to whether the man was who he says he was. Those were allegations.''

He was aware of the Interpol red notices - issued because the Chinese government ordered arrest warrants for embezzlement.

''Yes, yes that was referred to [in Yang's case file].  And that related to allegations that the Chinese government, as I recall, was making.''

Jones said his decision to approve Yan's citizenship was based on ''humanitarian grounds'' but will not elaborate until the trial concludes. A verdict is likely on Thursday.

He also received a letter from Yang's lawyer, John Billington QC and a number of parliamentary colleagues, including Labour MPs Dover Samuels and Chris Carter and National's Pansy Wong.

Asked if he acted ''as a minister should''  Jones replied: ''I made a very difficult call. I've made that call. I'm being maligned as a consequence of what an official has apparently said in the court etc and when the court case is over I will comprehensively and robustly defend myself.''

Jones gave assurances to Labour leader David Shearer over the weekend and showed him notes he has made from 2008.

He gave an account to colleagues at a weekly caucus meeting this morning. He will decide whether to release those notes over the weekend.

Last week the High Court at Auckland heard Yan boasted to immigration officials he had MP friends who would ensure he got citizenship.

Jones has insisted he received no money or gifts from Yang. And Jones also insists he did not travel with him to China, as was suggested last week in court. He believes he may have met him once but does not remember it.

Cunliffe said: ''The matter did come across my desk sometime before the citizenship issue. It was completely separate. The bar for the revocation of residency is a high one. From memory the evidence proposed to me from officials didn't meet that bar and I asked them to continue digging.

''There was some evidence but some of the advice I received from memory was an early decision may have nee vulnerable to appeal and therefore it was better for officials to continue their investigations.''

He hasn't seen the paperwork on citizenship but stressed there was ''probable cause'' for officials to continue their enquires into his residency.

Cunliffe said he ''may have met him once at a function.'' He was lobbied by ''two or three'' colleagues but declined to say who. ''Putting his side of the case...it did not affect my decision.''

He said there was ''conflicting evidence'' about the grounds of the Chinese arrest warrant.

Labour leader David Shearer is under pressure to stand Jones down because of his recent calls for government ministers John Banks and Nick Smith to quit.

''Politics is a brutal sport. I can understand Prime Minister Key wanting to see someone like myself stood down and it's really the politics of utu. We have a crack at John Banks and they have a crack at Shane Jones.''

Asked if an independent body should investigate to clear his name, he did not answer directly.

''The reality is that my name has surfaced in the context of testimony, apparently given by bureaucrats in the internal affairs department. I don't know those people. I think one of them was the chap that actually briefed me and I'll have more to say about that individual after the court case.''

All the more reason why we need a GREENs-led government to bring a bit of honesty back into politics.


Anyway, I reckon David Shearer should decide to sack Shane Jones.....provided Jonkey agrees to sack Banks Wanks before tomorrow's budget!

That way, both Labour and National could claim they have worthy principles instead of corruption & sleaze.

Fair enough?

The Chinese millionaire accused of falsifying citizenship papers has been found not guilty on all charges at the High Court in Auckland today.
 
Yong Min Yan, also known as Bill Liu, Yang Liu and William Yan, pleaded not guilty to four charges relating to false declarations on immigration papers in 2001 and 2002 and one of using false written statements to get citizenship.
 
Justice Timothy Brewer said "the Crown, at most, had achieved a high level of suspicion, but had not proved case beyond a reasonable level of doubt".
 
The verdict comes after Labour MP Shane Jones was stood down yesterday for granting Yan citizenship in 2008 despite advice to decline the application. Yan was also red flagged by Interpol regarding arrests made in China.
 
Yan allegedly boasted to immigration officials that he had MP friends who would ensure he got citizenship, the court was told.
 
MP stood down

Labour leader David Shearer has called Jones off the front bench until an investigation has been completed over the case.
 
Jones granted Yan's citizenship as Associate Immigration Minister when Labour was in power.
 
The decision was made on humanitarian grounds, Jones claimed, because a senior official told him Yan would be executed if he returned to China.
 
Shearer has called on the Auditor-General to investigate the decision-making process around the case.
 
The opposition leader said yesterday he had spoken with Jones about the matter and said there was no way he would clear his name simply by making comments
 
"So as a result of that we referred it to the Auditor-General," Shearer said.
 
Jones said the investigation was a good idea so that his side of the story could be heard.

A Chinese millionaire with multiple identities is accused by Chinese witnesses of corruptly obtaining false identity documents which he used to gain New Zealand citizenship.
 
The Auditor-General last week started an inquiry into how William Yan - also known as Yongming Yan and Yang Liu - was granted citizenship.
 
China claims Yan's real name is Yongming Yan and that he created the false identity of Yang Liu and used documents in that name to leave China, where he is wanted on allegations of multimillion-dollar fraud.
 
Nine Chinese witnesses gave statements to New Zealand authorities about how Mr Yan allegedly obtained fictitious documents including Chinese passports and ID cards, and household registration documents.
 
It is claimed that Mr Yan was able to use his links to unnamed politicians in China to influence officials to provide the false documents.
 
The statements were provided in 2009 when Auckland police officers went to China.
 
They are on the Auckland High Court file but the witnesses did not come to New Zealand to testify.
 
Prosecutor David Johnstone said that as Mr Yan's trial date drew nearer, "it became apparent the Chinese authorities were not making meaningful arrangements for witnesses to travel to New Zealand to give their evidence".
 
"The Crown had no choice but to confine its case to the documents offered to Australian and New Zealand immigration on behalf of Mr Yan."
 
The reason for the lack of action on China's part remains unclear, Mr Johnstone said.
 
Mr Yan was last month acquitted of five charges of making false statements on immigration and citizenship documents.
 
Justice Timothy Brewer said the evidence put before him "proves a situation that is highly suspicious".
 
Most of the documents were false but were filled out by others on Mr Yan's behalf.
 
"In the absence of firm evidence that the accused knew of the falsity ... there would need to be proof of dishonest intention in using the Liu Yang identity," the judge said.
 
"Such proof, of course, would have to come from admissible evidence.
 
"The Crown has not been able to put such evidence before me."
 
Mr Yan has said his different identities and birth dates are valid and came about because he was fostered out by his birth parents in China and both sets of parents registered him as part of their household with different names and dates of birth.
 
A Crown summary of the evidence of the witnesses in China alleges his multiple identities arose from him "developing close relationships with senior political figures in Jilin Province ... China" and promising to invest heavily in the area.
 
Witness statements included:
 
• Feng Gao, who said he was director of the Public Security Bureau in Tonghua County in 1999 when he was approached by "a standing deputy governor" of the county's government. As a result he assigned two policemen to provide protection to Mr Yan "who had apparently had some sort of business dispute".
 
Mr Gao said he was given to understand that Mr Yan "was supposedly about to invest heavily in Tonghua County".
 
He put his deputy, Shi Teng, in charge of providing security for Mr Yan.
 
• Shi Teng said he facilitated the creation of a false ID card in the name of Yang Liu and claimed Mr Yan also asked him if it was possible to change the date of birth from 1971 to 1969 on his identity document in his real name of Yongming Yan.
 
"I knew [Mr Yan] had very good relationships with both county and municipal leaders and it would be very easy for him to make this happen anyway."
 
• Xiu Hai Jia, Teng's boss, said that as a result of his part in the deception he was given a three-year suspended jail sentence and dismissed from his job as director of public security. Mr Jia said he directed a staff member to create a false identity document.
 
"The name I told him to write was Liu Yang, and the date of birth was 20 October 1972. The ID card number was comprised of this date of birth and the code of the Xinglin Township Police Substation Precinct, which I was director of."
 
"In fact, there was no real person with those particulars in my precinct at all, and the document is completely false."
 
Had the Chinese witnesses been called to testify, Mr Yan's defence planned to call evidence that oral and documentary evidence given in China was unreliable.
 
In a submission in 2008 in support of Mr Yan's application to be granted citizenship, John Billington, QC, said there were no false passports and his client had used both identities in China.
 
He accused New Zealand officials of taking a subjective view on unproven allegations.
 
Mr Yan's insistence that he is one man with two legitimate identities is at odds with a letter written on his behalf in January 2001 to Australian authorities that purports that Yongming Yan and Yang Liu are two different people.
 
The letter, an exhibit in the recent court case, was in support of a business visa application by Yang Liu and was written by an agent with whom Mr Yan was closely associated.
 
It said Yongming Yan was general manager of Tonghua Golden Horse Pharmaceutical Ltd and had decided to set up a sales office in Sydney.
 
"His assistant Mr Liu has been assigned to Australia to finilise [sic] the task."
 
During the trial, New Zealand Internal Affairs case officer Johannes Gambo alleged that Mr Yan had admitted that he used two identities because he didn't want Australian immigration officials to "know that I've been there".
 
Unheard evidence
 
* Mr Yan was last month found not guilty of making false statements on immigration and citizenship documents. Justice Timothy Brewer said the circumstances were "highly suspicious" but there was no admissible evidence to prove Mr Yan had dishonest intentions.
 
* Witness statements prepared for the case by Chinese officials had alleged Mr Yan obtained false identity documents through corruption to gain New Zealand citizenship.
 
* But the claims were never tested in court because the witnesses did not come to New Zealand to give their evidence. The defence planned to argue the officials' claims were unreliable.
 
* The case has been controversial because when Labour MP Shane Jones was a Cabinet minister, he granted Mr Yan citizenship in 2008, against the advice of officials, who said he had not met good character requirements.
 
* The Auditor-General this week appointed Francis Cooke, QC, to conduct an inquiry into Mr Jones' decision and the circumstances surrounding it.

A Chinese millionaire on trial in the High Court at Auckland for fraud boasted to immigration officials that he had MP friends who would ensure he got citizenship.

The high-ranking officials were stunned when then Cabinet minister Shane Jones approved the application one day after getting his file. They were certain Yong Ming Yan, also known as Bill Liu, who had been red-flagged by Interpol, stood little chance.

But Yan leaned back in his chair, with his arms behind his head, and said he was 99 per cent confident he would get citizenship, the court was told yesterday.

"He said he had a lot of support from members of Parliament ... he was going to take them to China," Internal Affairs case officer Olele Johannes Gambo said.

If proven, the allegation of special treatment would be serious enough to warrant investigation by the police.

Yan was granted citizenship by Mr Jones in 2008, after officials repeatedly told him that Yan failed a required good character test, the court was told. ...

...Yan's age and true identity are unknown. Court files refer to him as William Yan, Bill Liu and Yang Liu, list several birth dates and say he arrived from China in 2001.

He is appearing before Justice Timothy Brewer on five charges that he fraudulently used documents to falsely claim New Zealand citizenship.

Mr Jones last night refused to comment "while it's in front of the court". He had "most certainly not" gone to China. Mr Samuels did not respond to a request for comment.

Police have raided the luxury penthouse of a multimillionaire businessman granted citizenship in controversial circumstances and seized his assets because of alleged involvement in money laundering.
William Yan - also previously known as Bill Liu, Yang Liu and Yong Ming Yan - lives on the 35th floor of Auckland's Metropolis tower. Residents saw detectives removing items from his home on Thursday.

Millions of dollars worth of assets the police allege belong to Mr Yan - although officially registered in other people's names - have been seized, including the apartment, worth more than $2 million, a Mercedes-Benz, and shares and bank accounts.

Mr Yan has spent millions of dollars as a high roller in the SkyCity Casino VIP lounge.

Following the raid, Mr Yan, dressed casually in a black tracksuit, met defence lawyer Simon Lance in the Metropolis lobby.

No criminal charges have been laid. Mr Lance would not comment on what the police had taken. "However, Mr Yan does deny any alleged money laundering or other illegal activity. He has not been arrested."

The police would not answer specific questions, but released a statement from Detective Senior Sergeant Craig Hamilton, the officer in charge of the asset-recovery unit. ...
